Mount Lebanon Appeal Court: Homosexuality is not felony

The Penal Court of Appeal in Mount Lebanon, Room 12, headed by Judge Randa Kfouri, ruled on July 12 acquitting two persons indicted with same sex charges. It considered that a relationship between homosexuals is not a crime if it did not take place in a public space or did not involve a minor who requires protection. The decision supports an earlier ruling by Judge Rabi’ Maalouf in 2017. In its comment on the decision, the Legal Agenda said it is a first from an appellate court and not by single criminal judges, hoping it will expand the circle of progressive judges who keep with social and scientific developments at all times, including prosecutors, in order to end the prosecution of homosexuals which, in itself, is a breach of fundamental human rights and freedoms that are protected by the Lebanese Constitution and by international conventions. To recall, four lawyers from the Legal Agenda have pleaded before the court at June 18 session and they are, Yumna Makhlouf, Nizar Saghieh, Gida Franjieh and Karim Namour. Makhlouf has asked the reverse of the appeal in line with Article 534 of the Lebanese Penal Code which stipulates that sexual acts against nature are punishable by one month up to a year in prison and a fine ranging from LBP 200,000 and LBP one million but which does not consider sexual orientation as criminal.(The Legal Agenda, L’Orient Le Jour, July 13, 16, 2018)

Deportation of battered Kenyan MWDW because of Kafala

Notwithstanding the latest decision by the General Security to suspend the deportation of the Kenyan migrant domestic worker Shamila and her national who were beaten in the neighborhood of Burj Hammoud last June (c.f: https://bit.ly/2LiXSTE), Shamila was reportedly deported on Sunday, according to the Legal Agenda following up the case, while noting that, the court hearings on the incident are still ongoing. The Agenda stressed that Shamila’s expulsion was made possible supported by the Kafala (sponsorship) system which relinquishes the fate of MWDWs to their sponsors. The latter, a woman in this case, has refused to waive Shamila’s kafala, demanding USD 3000 for bailing her out. When the amount was not paid, the employer booked a plane ticket to force her to leave the country. On the other hand, Al Mustaqbal newspaper pointed to the famous Dora Roundabout which becomes every weekend a meeting place for MWDWs from different African and Asian nationalities. The visitor, Al Mustaqbal wrote, pictures himself outside Lebanon and travels with the dialects, colors and traditions of Dora Sunday street goers, namely to India, Pakistan, Indonesia, Philippines, Bangladesh, Sri Lanka, Ethiopia and others. There, visitors can discover various fashion, food, jewelry, beauty and hairdressing parlors which characterizes each of the above countries, the newspaper added. Still on the front of migrant workers, the General Security Director General Abaas Ibrahim met the Ethiopian Minister of State for Labor and Social Affairs in the presence of the director of FENASOL, Castro Abdallah, to discuss matters relevant to Ethiopian and African MWDWs in general. Muhajaba (veiled) woman director of brewery factory in Damascus

The Syrian industry minister Mohamad Mazen Ali Yousef issued a directive last week appointing Reem Halale, a veiled (muhajabah) Muslim woman as director to the Barada Brewery in Rif Damascus. Halale, to recall, is the current assistant general director and marketing executive of the General Establishment for Food Industries and a former planning director at the ministry of industry (between 2005-2014). The above decision has sparked controversy among Syrians on social media who saw it as contradictory in terms of what the connotation when a committed muhajabah woman manages an alcoholic drink factory that is forbidden in Islam. For her part, Halale described the minister’s decision as a sign of utmost trust on his part, pledging to do everything she can to repair the local brewery in partnership with a private sector investor, noting that the factory has been demolished in 2012 at the start of the war in neighboring Syria. Likewise, and in response to the wave of objections to Halale’s appointment, the ministry said in a statement that, the decision aimed to cut spending and benefit from the experience of cadres of industrial enterprises and of operational companies in managing the affairs of suspended businesses. And as an assistant to the general director of the General Establishment for Food Industries under which Barada Brewery is enlisted, Halale was assigned to run certain administrative matters, the statement concluded. 10 thousand driving schools for women in Saudi Arabia

After Saudi women were allowed to drive inside Saudi Arabia (c.f: https://goo.gl/A52YQu), driving schools thrived in the Kingdom to reach nearly 10,000 offices, Al Diyar reported yesterday. The newspaper pointed out that women enrolled in driving offices belong to the age group (20-30 years) and are expected to become drivers in two months. According to the plan, some 100,000 women will learn to drive in the immediate future and 250,000 women over a year, which is the highest record for a country in the world. Saudi Arabia, Al Diyar wrote, is anticipated to import half a million additional cars, noting that households and parents have by now purchased or booked cars for their daughters to be delivered to them during this coming September and the New Year. Minister Guidanian: Rumors and bad news undermine tourism in Lebanon

The tourism minister in the caretaker government, Avedis Guidanian, held a joint press conference on July 13 with the president of the Lebanese Federation for Tourism Industries, Pierre Achkar, president of the Restaurants Syndicate, Toni Rami, and Maritime Resort Owners Association, Jean Beiruti, to talk about the situation of tourism in the country. Guidanian reminded the audience that at the start of every summer season unwanted rumours and bad news pop up mainly through social media, which negatively impact the tourism sector, like news of the air and sea pollution and overpriced accommodation as compared to abroad. This is not true, Guidanian stated, citing the Forbes magazine which classified Lebanon on the list of the cheapest tourist destinations in the world. There are luxurious and posh hotels that offer quality accommodation and special features, while on the other hand, there are modest tourism institutions that offer budget prices. Similarly, Achkar considered that such rumours constitute a war on the existence of Lebanon and its touristic port, noting that tourists flock to the country from all parts of the world. He disclosed that around 150 travel and tourism agencies have signed up to participate in Visit Lebanon Forums 2017 and 2018 and toured the different Lebanese areas but did not allude to the undesirable news aired on TVs and media channels. And while Achkar reiterated Lebanon’s tourism prominence in the region as per its distinctive potentials in the industry, he pointed to a decline in tourism expenses, stressing the need to highlight the positive traits the country boasts. Free computer, English language courses for Hasbaya women

In collaboration with the Municipality of Hasbaya, the Community Association for Student Support organized last week free training courses in computer and English language for women and girls in the district. These sessions come as part of Creation of Women and Girls Safe Spaces (WGSS) initiative which is the outcome of the Active Citizenship workshop implemented by the British Council and funded by the EU. The training courses aimed to improve and enhance the capacities of women in society were highly appreciated by a large number of women in Hasbaya. (Al Akhbar, July 14, 2018)

Bassil: all trade roads open between Lebanon and Syria

The president of the Free Patriotic Movement, foreign minister in the caretaker government, Jibran Bassil, said that all roads between his country and Syria, Iraq and Jordan will reopen and Lebanon will breathe again through these land arteries, stressing that political life between Syria and Lebanon will be restored as well. Bassil was speaking on July 13 where he represented President Michel Aoun during the Lebanese Arak Day and International Day of Tasting organized by the ministry of agriculture, in cooperation with the municipality of Zahle-Maalaqa-Taanayel and the Lebanese National Energy Association. During the event held at the Zahle Municipal Park, Bassil pointed out that the interest in Lebanese arak does not take much toil compared to the marketing of domestic wine, as the latter is an accomplished Lebanese product while arak is a heritage commodity of Lebanon produced to resonate its authentic qualities. The foreign ministry through the Directorate of Economic Affairs and through diplomatic missions and embassies, seeks to market agri food goods, specifically the traditional mooneh items in foreign outlets, Bassil maintained, disclosing that a key task of the new economic attaches is promoting made-in-Lebanon products in international markets. He stated that he will charge the Lebanese missions abroad to campaign for the national arak in order to increase the size of production, concluding by saying that the development of agriculture is requisite for Lebanon’s persistence. Unemployment in Lebanon exceeds 35% with poor prospects of improvement

The economic expert professor Jasim Ajaqa disclosed that unemployment in Lebanon exceeds 35%, pointing that out of 30 thousand graduates each year, only 3 thousand work in their field of study. Ajaqa told An Nahar newspaper that the published unemployment estimates are not accurate, sustaining that the World Bank and the IMF do not give the real figures, which remain according to their expectations at the threshold of 6%. The reason for that is the lack of a scientific and tangible definition for unemployment, like for example, the person who works one or two hours daily and receives money is counted on the Lebanese workforce, according to WB standards, while in reality he is on the dole, Ajaqa explained. What exacerbates the gravity of such figures, Ajaqa noted, is a joint study released recently by the labor ministry, the Social Security Fund and Kodorat Association which uncovered that unemployment has exceeded 36% and is soaring to 46% in Akkar, Baalbaq and Hermel, and to 42% among the 18-24 age group. Ajaqa also mentioned the considerable size of the foreign labor force in the country, especially in the absence of declaration by owners of institutions about the number of their non-Lebanese staff. Moreover, he added, the euphoric expectations around the Cedar donor conference which gave priority to infrastructure projects, might not have a stake for Lebanon’s youth, firstly because many Lebanese might not work in these undertakings, and secondly, because young graduates are over qualified to take these jobs. Unemployment here has reached dangerous levels, be it disguised or visible, Ajaqa warned, concluding, “what an economic catastrophe for a nation that has no future for its young generation or at least, for a nation whose youth is jobless”. Eco-friendly bags in Jbeil

As part of efforts to protect the environment against plastic pollution, The municipality of Jbeil Byblos launched on Wednesday a new initiative to replace plastic bags with eco-friendly ones by end of the year. It urged commercial establishments and shops to start using bags that are made of biodegradable material or recyclable fabric. This initiative is first of a kind for it constitutes a serious and binding communique issued by a municipality to concerned institutions, while noting that the memo includes not only single use plastic bags consumed by the supermarkets and retail outlets but also ready for packing and food delivery bags and packages. On the campaign, the mayor of Jbeil, Wissam Zaarour, told Al Modon electronic portal that the decision comes in the framework of the municipality’s vision to reduce the risks of plastic waste and its catastrophic effect on human health and the environment. The city of Jbeil lies by the sea, he said, and the plastic bags need some 30 years to decompose in water, besides their adverse impact on health, fish resources and marine life. Rabia Hamiyeh, a new victim of domestic violence

Rabia Hamiyeh, 35, a mother of two daughters, was found shot dead with three bullets in a pitch in the Beqaa town of Taraya. Circumstances are still unknown about motives of the crime, as said the chief of the ISF Public Relations Department, Colonel Joseph Msallam, who preferred not to comment pending the results of ongoing investigation. L’Orient Le Jour newspaper wrote about more than one version on the murder. While the victim’s mother, Iman, disclosed that the husband’s family trades in prohibited items and that they killed her after she threatened to tell the authorities what she knows. The mother pointed out that her daughter who after the death of her father was brought up in her paternal grandfather’s house, was forced to marry at the age of 14 where she was incessantly beaten and humiliated. Two months ago, the mother went on to say, the victim managed to get the divorce, which possibly contributed to the decision to kill her. According to the in laws family account, the murder is related to the victim’s indecent behavior, and is hence considered a crime of honor, an account that was fully rejected by the victim’s mother. For her part, lawyer Leila Awada from Kafa organization, pointed to an official slackness in monitoring crimes against women, in addition to a laidback and hasty labeling of similar crimes under the category of ‘honor killings’ which was purportedly scraped in 2011.
